हैदराबाद विश्वविद्यालय: 400 एकड़ पेड़ों की कटाई पर क्यों मचा बवाल?

तेलंगाना के हैदराबाद विश्वविद्यालय में लगभग 400 एकड़ क्षेत्र में फल फूल रहे पेड़ों की कटाई का मामला फिलहाल शांत हो गया है, लेकिन आखिर यह मामला क्या है, जो पूरे देश में चर्चा का विषय बना हुआ है। आइए जानते हैं।

विश्वविद्यालय के कांचा गाचीबोवली के वन सरीखे क्षेत्र में तेलंगाना स्टेट इंडस्ट्रियल इन्फ्रास्ट्रक्चर कॉरपोरेशन को आवंटित किए जाने के खिलाफ छात्र और पर्यावरणविद मिलकर विरोध प्रदर्शन कर रहे थे। कॉरपोरेशन इस भूमि की नीलामी करके एक आईटी पार्क विकसित करना चाहता है। 

यही वजह है कि राज्य प्रशासन तेलंगाना के रंगारेड्डी जिले के सेरिलिंगमपल्ली मंडल में मौजूद कांचा गाचीबोवली के पर्यावरणीय रूप से संवेदनशील वन जैसे क्षेत्र को उजाड़ रहा था।  यह जगह हैदराबाद के ‘फेफड़े’ के रूप में जाना जाता है। यह भूमि कभी चरागाह हुआ करती थी (‘कांचा’ का तेलुगु में अर्थ है ‘चरागाह भूमि’)।

यह क्षेत्र 700 से अधिक फूलों के पौधों की प्रजातियों और 200 से अधिक पक्षी प्रजातियों का आश्रयस्थल है। इस भूमि क्षेत्र में पहचाने गए स्तनधारी और सरीसृपों में मॉनिटर लिज़र्ड, इंडियन रॉक पाइथन, हिस्पिड हरे,  पी फॉल,  चार-सींघ वाले हिरण, हनुमान लंगूर, पैराडाइज़ फ्लाईकैचर, बगुले, आइबिसिस, ईगल आउल और साही शामिल हैं। (स्रोत: द वायर) 

इन जैव विविधताओं को बचाने के लिए पर्यावरण संरक्षण के लिए काम करने वाली एक गैर-सरकारी संस्था वता फाउंडेशन ने उच्च न्यायालय में एक जनहित याचिका दायर की। 

याचिका में इस भूमि को "डीम्ड फॉरेस्ट" यानी अर्थात संभावित रूप से वन क्षेत्र) का दर्जा देने और वन्यजीव (संरक्षण) अधिनियम, 1972 की धारा 35 के तहत इसे "राष्ट्रीय उद्यान" घोषित करने की मांग की गई है।

हालांकि राजस्व रिकॉर्ड में इस विवादित भूमि को वन क्षेत्र के रूप में सूचीबद्ध नहीं किया गया है, फिर भी वता फाउंडेशन ने सरकार से इस स्थान के लिए मास्टर प्लान तैयार करने की प्रक्रिया को रोकने का आग्रह किया है।

यह मुद्दा नया नहीं है। यह 20 साल पुराना भूमि विवाद है, जिसकी जड़ें अविभाजित आंध्र प्रदेश से जुड़ी हैं। एक लंबी कानूनी लड़ाई और सर्वे के बाद तेलंगाना सरकार ने इस पर्यावरण संवेदी 400 एकड़ भूमि पर दावा किया। जबकि विश्वविद्यालय संबंधित जमीन के सर्वेक्षण की बात से इनकार कर रहा है।  

पहले यह भूमि एक निजी कंपनी को आवंटित की गई थी, लेकिन बाद में इसे राज्य संचालित निगम TSIIC को स्थानांतरित कर दिया गया।

छात्र संघ के उपाध्यक्ष आकाश कुमार ने बताया कि सरकार ने 30 मार्च, 2025 की रात 40  से 50 भारी मशीनों यानी अर्थ मूवर्स को तैनात कर जमीन को समतल करना शुरू कर दिया, जबकि वता फाउंडेशन का मामला अब भी अदालत में लंबित था।

अदालत का हस्तक्षेप

तेलंगाना उच्च न्यायालय ने  गुरुवार, 3 अप्रैल 2025 को अपने अंतरिम आदेश को आगे बढ़ाते हुए कांचा गाचीबोवली के पर्यावरण संवेदी क्षेत्र  में पेड़ों की कटाई पर यथास्थिति बनाए रखने (स्टेटस क्वो) का निर्देश दिया।

सुप्रीम कोर्ट ने भी इस मामले पर स्वतः संज्ञान लिया और पेड़ों की कटाई रोकने का आदेश दिया। अदालत ने तेलंगाना के मुख्य सचिव को फटकार लगाई और यह सुनिश्चित करने को कहा कि "कोई पेड़ नहीं काटा जाएगा।"

सुप्रीम कोर्ट में न्यायमूर्ति गंवई ने राज्य सरकार को कड़ी फटकार लगाते हुए कहा,
"जंगल हो या न हो, आपने पेड़ काटने की आवश्यक अनुमति ली है या नहीं... 2-3 दिनों में 100 एकड़ साफ कर देना काफी गंभीर मामला है। हम सिर्फ एक बात याद दिलाना चाहेंगे - कोई कितना भी ऊंचा हो, कानून से ऊपर नहीं हो सकता।"

अदालत के आदेश की अवहेलना?

स्थानीय प्रत्यक्षदर्शियों का कहना है कि तेलंगाना उच्च न्यायालय द्वारा स्टे आदेश जारी किए जाने के बावजूद, लैंड मावर्स (मिट्टी समतल करने वाली मशीनें) कांचा गाचीबोवली के पारिस्थितिकी तंत्र को नुकसान पहुंचाती रहीं।

सुप्रीम कोर्ट में रोचक बहस

सुप्रीम कोर्ट में एक दिलचस्प तर्क देखने को मिला। राज्य सरकार का दावा था कि वे "झाड़ियों" (shrubs) को साफ कर रहे थे, पेड़ों को नहीं। इस पर न्यायमूर्ति गवई ने स्पष्ट किया कि "झाड़ियां भी कानूनी रूप से वन की परिभाषा में आती हैं" और सरकार के इस तर्क को चुनौती दी।

अब सवाल उठता है कि अगर केवल झाड़ियां हटाई जा रही थीं, तो फिर दर्जनों भारी मशीनों को क्यों तैनात किया गया? और कांचा गाचीबोवली के समृद्ध पारिस्थितिकी तंत्र को क्यों उजाड़ा गया?

Kanche Gachibowli Land Row 2025 

The news 

On Sunday night, March 30, 2025, the peacocks and peahens in Hyderabad were growling out of agony; and other wildlife felt homeless. Hear it yourself. This was because the earth movers were mowing down the trees of Kanche Gachibowli’s forested land, in Hyderabad, Telangana. 

Since last weekend, students of the University of Hyderabad (UoH), have been staging heavy protests to stop the razing in 400 acres of forested land. 

But why are they protesting? And what are they protecting?

Details 

The students and conservationists are protesting against the allocation of 400 acres of land to the Telangana State Industrial Infrastructure Corporation (TSIIC). This State owned corporation has planned to auction this land to develop an IT park. Thus, the state admin is razing the ecological sensitive forested land of Kanche Gachibowli, which falls in the Serilingampally mandal of the Rangareddy district of Telangana, which is popularly tagged as the ‘lungs’ of the IT city, Hyderabad. 

It was once a grazing land ( in Telugu means ‘grazing land’) 

It is a haven to more than 700 species of flowering plants and more than 200 species of birds. (Frontline, Ayesha Minhaz) 

Among the species of mammals and reptiles identified in this land parcel were monitor lizard, Indian rock python, hispid hare, peafowl, four-horned antelope, hanuman langurs, paradise flycatchers, herons, ibises, eagle owls and porcupines. (Text Source: The Wire). 

To protect these, Vata Foundation, an NGO working for environmental conservation filed a public interest litigation (PIL) in the high court seeking “deemed forest” status to the land and demanding that it be declared as a “national park” under Section 35 of Wildlife (Protection) Act. Even though the disputed land was not identified as forest land in revenue records, the Vata Foundation urged the government to stall preparation of a master plan for the site. 

Now, this issue is not new. A 20-year land dispute, dating to undivided Andhra Pradesh, saw Telangana reclaim 400 acres after legal battles. Despite government claims of a survey, the

university denies it occurred. The land, initially allotted to a private company, was then transferred to the state-owned TSIIC. 

Akash Kumar, vice-president of the student union, said the government resorted to flattening the ground by deploying 40 to 50 earth movers on Sunday night even when the case of Vata Foundation was pending in court. 

The Vata Foundation expressed apprehension that the government may cut trees in an area of 150 acres out of the total 400 acres to implement the master plan. 

The Telangana High Court on Thursday (April 3, 2025) extended its interim order of status quo with respect to tree felling at State's Kancha Gachibowli forest area near the Hyderabad Central University campus. 

Notably, the Supreme Court has also ordered to stop the tree felling action in its suo motu cognisance. The court has pulled up the Chief Secretary of Telangana to ensure that “no tree felling” takes place. 

It came down heavily on the state government, stating, "Forest or not, whether you have taken requisite permission for felling trees...100 acres in 2-3 days is something...we would only remind one sentence - howsoever high one may be, not above the law." Justice Gavai said. 

Now, the local witnesses claim that even after the stay order of the Telangana high court, land mowers continued to raze the ecology of Kancha Gachibowli. 

An interesting argument in the Supreme Court occurred. 

The apex court questioned Telangana government's claim of clearing "shrubs," not trees, in a disputed area. Justice Gavai clarified that even shrubs fall under the legal definition of "forest," challenging the state's actions. 

Here, the question arises, as per the visuals on ground, why did they deploy dozens of earth movers to clear something as small as “shrubs” and disturb the rich ecology of Kanche Gachibowli?
